GENERAL TERMS AND CONDITIONS

SCOPE

These “General Terms and Conditions” shall apply to all orders placed through the online store www.raraavisstore.com. The contractual partner for all orders shall be Rara Avis Store S.L. (N.I.F. B-84447531). The version of the “general terms and conditions” at the time of the order shall apply.

CONCLUSION OF THE AGREEMENT

If you click on the "Proceed to checkout” button, you are placing a binding order for the items contained in the shopping cart. We will send you an order confirmation by e-mail immediately upon receipt of your order. We will store the text of the purchase agreement (the content of your order, as well as these terms and conditions) and send it to you when requested. You can also check the state of your order or contact us at any time through your Rara Avis personal account. The agreement is formalised in Spanish. There is no minimum order.

If logged in to our website, you can also manage, amend or change your personal data, billing and shipping addresses or check your order history and details, invoices, discount vouchers and wish lists through the "My Account” section.

PRICES AND SHIPPING COSTS

The prices indicated in the online store at the time of order shall apply. The prices indicated include the legally applicable value added tax. Shipping costs and other possible separate charges incurred depending on the method of payment (e.g. PayPal payments).

For international shipments we process and send parcels only through Correos España (registered parcel). The shipping costs are determined by Correos España and vary from year to year. When adding items to the shopping cart, shipping costs are automatically generated. If you have any doubts or questions, please contact us at pedidos@raraavisstore.com where we will provide you with the exact costs depending on your geographical location.

TERMS OF PAYMENT

We only accept advance payments by bank transfer, credit card or PayPal. If the transaction generates costs (as is the case of PayPal which involves an increase of 3.4% on the amount of the purchase), you must assume them. For payments by bank transfer in advance, you will have a period of 7 days (payment period) during which we will reserve the ordered products. We will only ship the products once payment has been received.

DELIVERY AND TIME OF DELIVERY

The total delivery time from order placement varies between 6 and 30 days depending on availability, payment method, product features and selected shipping method. We will send you detailed information through four different email messages:

1. Order confirmation
2. Accepted payment
3. Date of dispatch
4. Shipping confirmation

You can also consult your order status, download invoices and contact us at any time through the order history and details section of your Rara Avis account. For any specific information on delivery times you can check our terms and conditions, product features and availability.

In the case of holidays or exceptional festivities, orders will be served even if the establishment remains closed, and may be subject to delays which will be duly communicated to the customer.

Ordering items out of stock

In the event that the purchase has already been made and, for various reasons, the product is not available (problems in the replacement by distributors, out of stock or sold out musical products without possibility of reissue, etc.), we will contact you to notify the delivery time, offer you the possibility of exchanging it for another product or refund the amount of the merchandise purchased and not available. You can click on a product to check its features before making your order (limited edition, format, available copies, colour, date of publication, record label, etc.). All limited goods can be identified by the label "LIMITED" on their titles.

Regarding pre-orders, especially short-run distributed and available limited editions, we will provide you up-to-date information thorugh email or your Rara Avis account about its status (for instance, delays in the date of manufacture, distribution or shipment), trying to ensure your purchase and, if that is not possible, providing you alternative solutions.

GUARANTEES FOR CONSUMER GOODS

For any defective product, Rara Avis Store S.L. will proceed to repair or replace it, reduce its price or terminate the contract, as appropriate, all provided at no additional cost for the consumer and user. Rara Avis Store S.L. will answer to non conformity claims during a two year period since the deliverance of the good. Users and consumers must inform the seller of the lack of conformity within a period of two months from the date of detection. The obvious defects of the goods have to be communicated in written form to Rara Avis Store S.L. immediately upon delivery.

PRODUCT FEATURES

1. Product availability:

• 1.1 “Immediately available”, indicates that we have the product in our warehouse, taking the expedition of the same between 1 and 4 days once received the payment by the customer and processed the order by Rara Avis Store S.L.
• 1.2 “Ready to be shipped in 5 days” indicates the delivery time on the product marked by our distributors and the time of reception in our warehouse once received the payment by the customer, time to which are added between 1 and 4 days for the expedition by Rara Avis Store S.L.
• 1.3 “Release date”, indicates the approximate date on which the record label, distributor, etc. launches the product for sale in the market. To the products under this denomination the point 1.2 of "Product Availability” is applied.

3. Manic Panic hair dye and cosmetics.

Beginning in 1977, their vivid rainbow color dyes were one of the first products to be sold at the bespoke boutique on St. Mark's Place.

In the 90s, due to heightened demand, distribution of our products expanded tremendously. Since that time, Manic Panic® has worked continuously to make sure their formula remains the best on the market by listening to customer feedback and staying ahead of the trends by starting them.

In 2005, Manic Panic® introduced their Amplified formula for their Dye Hards that were looking for an even longer lasting formula. About the two NY sisters who started Manic Panic®

Manic Panic’s semi-permanent hair color contains fortified herbal and protein complex, and features no animal by-products. Our Hair Color can be used to achieve vibrant colors on pre-lightened or light blonde hair. Dark colors such as red, purple or green may be used to highlight naturally darker hair shades. It is always recommended you perform a strand test to see how the dye will look on you first.

Manic Panic Hair Color Is Tested On Celebrities, Not Animals!

Manic Panic hair dye does not damage hair and contains restorative properties, acting as a conditioner that hydrates and ”fills” processed hair.

Manic Panic Hair Color should be used exactly as supplied and described on the packaging. Do not add peroxide or other permanent hair colorants.

Manic Panic hair colorants may temporarily stain skin and permanently stain the fabric of clothes, towels and bedding etc. Do not use with alkaline based products as these will upset the pH balance needed for maximum absorption of color by the hair. Low pH or non-alcohol hair products are recommended.

Avoid contact with eyes and do not use Manic Panic Color for eyebrows or eyelashes. If contact with eyes occurs, rinse out with warm water and contact a doctor.

Please note: Not for internal use, avoid ingestion. Store in a cool, dry place. Avoid Freezing. Keep out of the reach of small children. For the best results, please use on porous, bleached, tinted or naturally light blonde hair. When applied to darker untreated hair, results may vary depending on hair shade and texture.

4. Stagarzer hair dye and cosmetics

Stargazer was established in 1978 with the opening of a stall in the Great Gear Market on the Kings Road London. Kings Road was the centre of the punk fashion in London at the time, and it was this attitude towards colour and outrage that moulded many of the company’s ideas behind the ranges they produce.

In the 1980’s, Stargazer began to expand bringing the colours they produced to a wider audience. Then, in the late 1980’s, they started to slowly produce the products themselves. They now produce the majority of the products in-house. Since Stargazer was first launched, they have expanded their product range considerably, in an effort to offer their customers a wide range of cosmetics and hair colouring products with a wild, colourful and in your face feel to them.

Looking forward they still make colour and products with the same passion and excitement as they did in 40 years ago.

Stargazer is a semi-permanent hair colour dye with conditioner for direct application to the hair. Free of ammonia or peroxide, stargazer hair colour allows you to achieve a wide range of vibrant translucent colours. Stargazer hair colour can be applied to natural, dyed or bleached hair. For best results use on pre-lightened hair (please note that Stargazer hair colours will not cover white or grey hair). The Stargazer hair colours can be mixed together to produce an ever wider array of colours (except the silver and white toners). A pair of disposable gloves are included for use with the hair dye. The Stargazer Semi-Permanent hair colours are not tested on animals and never have been.

Wash Care: Gentle machine wash with similar colours, wash inside out. Do not tumble dry. Iron print on reverse. The colors of the products, as displayed on your screen, depend on many factors. A color is often displayed slightly differently on each type of monitor, LCD screen, mobile device and so on. In addition, the settings of a screen also play a role and also makes it matter whether you look at your screen during the day or in the evening. In short, a lot of factors play a role in displaying colors. This makes it possible that the color of a garment differs slightly from the color you have seen on your screen. We try to keep this deviation as small as possible by placing good pictures on our website, but take it into account.
